Question:
Can an employer accept proof of supervisory training for a supervisor that was completed while he or she was with another employer?

Answer:
Yes, but I would like to emphasize that it has been our experience the enforcement community (DOT, CHP & PUC) requests that the proof (usually in the form of a certificate) needs to state that the training fulfills the FMCSA DOT CFR 49 Part 382 requirements for training on alcohol misuse and controlled substance use. Lately we have seen many certificates where the individual completed a course through various trade associations and no where on the certificate does it state what was covered in the training, that the DOT requirements were fulfilled (if applicable) or anything that refers to the instructor’s qualifications or authenticity of the certificate

2007 Renewals Have Been Mailed!

For those of you who have chosen to utilize C-DATA as your drug and alcohol testing program administrator, you should have received your 2007 C-DATA renewals in the mail. The renewal forms were mailed out on October 6th. Please contact our office at (800) 820-9314 if you do not receive them by October 25th.

Make sure to read all of your enclosed materials including the Consortium Agreement Form 003. Also, review the Company Profile Report to make sure all of your information is up-to-date and accurate, make any needed corrections and return it with your renewal Form 005. The Consortium Agreement 003 must be completed (signed) on both sides.

If you are an owner-operator, you must sign both the agreement and the renewal form. For companies, it must be an authorized representative that we have on record. Remember, any incomplete renewals will be returned and this will delay your enrollment processing!

Is Your Company Up-To-Date On Your Supervisor Training?

As most of you may already know, federal regulations (CFR 49 Part 382) requires that any company that has commercial drivers must have a designated person to supervise those drivers. This person must have completed at least 60 minute training on alcohol misuse and 60 minutes on controlled substances use. Supervisor training also holds true for companies with employees that want to initiate reasonable suspicion testing for any of their employees and has this in their written company policy. The person designated needs to be someone that interacts, preferable on a daily basis with the employee, knows their work habits, gauges their attendance and would be able to notice any visible changes in the employee’s appearance or behavioral patterns. Documentation is also a very important step leading up to the initiating of reasonable suspicion testing. (Refer to §382.603 & §382.307)

Once you have been trained, there is no current requirement to retake the course, but if it has been some time since you completed the training or your trained supervisor has had a position change and is no longer involved in the daily interaction with the employees you may want to consider training another person as a back-up. For just a few hours of time and less than $100, the investment can prove to be very cost efficient should an issue arise in the future.

Supervisor Training Seminars Planned for Oct. 21st

C-DATA will be sponsoring a Supervisor Training Class in both English and Spanish at the Construction Truck and Equipment Expo & the Latino Truck Show on Saturday October 21st at the Fairplex in Pomona, CA, in the back area Building #4. Also see page 20. The class will be offered in English from 9 a.m. - 12 p.m. and Spanish from 1 p.m. to 4 p.m. The instructor for this three (3) hour class will be Dr. Karmen Payne with Karmen EAP, International. This class will include one (1) hour of training on alcohol misuse and one (1) hour on controlled substances as required under the DOT, but as an added bonus, the additional hour Dr. Payne will instruct you on what is required once the donor has tested positive and steps needed to complete the Return to Duty process. This would be a good opportunity for employers to have additional supervisors trained or to refresh their training. Anyone interested can contact C-DATA at (800) 820-9314.
